The laws vary a lot from state to state. My guess would be that liability in a grocery line would depend on exactly what ensued. If an unlicensed person were handing out business cards in a grocery line, he could probably get gigged by the board, but it would be very difficult to call that practicing engineering. If there were only hearsay evidence of what went on, it would be very difficult to make a complaint stick. Putting up a sign, taking out an ad or making a personal offer to provide engineering services is a different matter.

I've heard a lot of third-hand horror stories about mis-application of the law, but very little that's verifiable. Unless someone actually purports to be in the engineering business himself, rather than an employee of someone who's in business, there's no liability.
